End-User License Agreement for Puff Utica App

Acknowledgment

By downloading or using the App, you accept and agree to this Agreement. If you do not agree, do not use the App. 

This Agreement is solely between you and Puff Utica—not with the Application Store. The Company is responsible for the App, not Apple or Google.

Use by family or via group purchase is also subject to this Agreement. The App is licensed, not sold.

License

Scope of License

Puff Utica grants you a revocable, non-transferable, non-exclusive license to use the App strictly as outlined here and within the rules of the Application Store.

License Restrictions

You agree not to:

• Sell, sublicense, or otherwise commercially exploit the App.
• Reverse, engineer or modify the App.
• Post or distribute objectionable, unlawful, or infringing content.
• Violate any proprietary rights.
• 
  Content Restrictions

You are solely responsible for any content or activity under your account. You must not post:

• Illegal, harmful, or obscene content.
• Defamatory or discriminatory material.
• Viruses or malware.
• Misleading or impersonated information.

Puff Utica reserves the right to remove content at its sole discretion and restrict access if these terms are violated.

 
Intellectual Property

All intellectual property in the Application belongs to Puff Utica. You are granted no rights beyond the limited license.

Suggestions

Any feedback or suggestions you submit become the sole property of Puff Utica without credit or compensation.

Modifications & Updates

Puff Utica may modify or update the Application at any time without obligation to maintain features.

Maintenance and Support

Puff Utica provides no obligation of maintenance. The Application Store is not responsible for support.

Third-Party Services

The App may link to or include third-party services. Puff Utica is not responsible for third-party content or terms.

Privacy Policy

Our data handling practices are outlined in our Privacy Policy. By using the App, you agree to these practices.

Term and Termination

This Agreement is effective until terminated. You may terminate it by uninstalling the App. Puff Utica may terminate it if you violate any term.

Indemnification

You agree to indemnify Puff Utica from any claim arising from:

• Your use of the App,
• Your violation of this Agreement,
• Any third-party rights infringement.

• No Warranties

The App is provided "as is." Puff Utica disclaims all warranties, including fitness for purpose, non-infringement, or performance.

Limitation of Liability

To the fullest extent allowed by law Puff Utica shall not be liable for indirect or consequential damages. Maximum liability is limited to $100. 

Severability and Waiver

If any part of this Agreement is held invalid, the rest remains in effect. Failure to enforce any term is not a waiver.

Product Claims

Puff Utica is not the App Store—is responsible for handling claims related to the App, including product liability and regulatory compliance.

U.S. Legal Compliance

You confirm that you are not located in or associated with any country or entity restricted by U.S. law.

Changes to Agreement

We may update this Agreement at any time. Continued use of the App means you accept the revised terms.

Governing Law

This Agreement is governed by the laws of Michigan, USA.

Entire Agreement

This Agreement supersedes all prior terms between You and Puff Utica regarding use of the App. Additional terms may apply for other services.
